IGSaver - Terms of Service

Introduction

1.1 IGSaver Apps (hereinafter collectively referred to as "Apps") are developed and operated by IGSaver (hereinafter referred to as "IGSaver" "Us" or "We").

1.2 Individuals or enterprises (hereinafter referred to as "You" or "Users") shall thoroughly and carefully read the Terms of Use (hereinafter referred to as "Agreement") before using or accessing our Services. While using our Services, You are deemed to have fully understood and accepted and are willing to abide by all of the following terms. By using our services, You declare that You are of 18 years of age (or the legal age of majority in your jurisdiction). If You are under 18 years of age (or the legal age of majority in your jurisdiction), You are not entitled to use our services.

1.3 IGSaver reserves the right to make modifications to this Agreement (including but not limited to any terms, conditions, or notices related to the use of our service) at any time. Modifications to this Agreement will be posted on our service or in such other ways as IGSaver deems appropriate. You should review this Agreement periodically as the modified terms will be immediately binding upon You. If You do not wish to be bound by this Agreement, You may cease using our Services at any time. Continued use of our Services shall be deemed Your full acceptance of the modified Agreement.

Scope of License and Conditions of Use

1.1 License Grant: Subject to the terms of this Agreement, IGSaver grants You a limited, non-exclusive, non-transferable, revocable license to install and use our APP on one mobile phone device for non-commercial purposes only. You shall not use our APP for any other purpose.

1.2 Service provided: Through our service, You can download videos and photos that are publicly posted on social platforms like Instagram.

1.3 Conditions of use: Your use of our Services is on condition that You will not:

• use our Services in any way that breaches this Agreement and/or any applicable law;
• copy or resell any part of our Services;
• sublicense our Services to any third party, or otherwise authorize, allow or cause any third party to use our Services;
• copy, modify, or create derivative works of our Services or any part of it;
• incorporate any portion of our Services into any other programs without our prior written consent;
• decompile, disassemble, translate, or adapt the object code of our Services or otherwise attempt to derive the source code of any part of our Services;
• remove or alter copyright notices or other proprietary notices, marks, logos and marks on our Services;
• attempt to interfere with or disrupt our Services or services, servers or networks connected to our Services;
• make, transmit or store any material, which is designed or intended to harass, threaten, defame, offend, extort, harass, violate the privacy rights, be obscene, defamatory, insulting, make illegal threats, spreading hate speech, incite violence, or any other material that in our opinion potentially infringes upon the rights of others;
• propagate to any third party program code, files or programs which may cause damage, loss or harm to their property;
• circumvent our website's homepage by direct linking or any similar mechanism;
• use any data mining, robots, or similar data gathering methods;
• impair rights of minors in any way;
• infringe any patent, trademark, trade secret, copyright, or other intellectual property;
• impersonate any person or entity (including but not limited to IGSaver and its employees or representatives), or falsely state or otherwise misrepresent your affiliation with a person or entity;
• manufacture, distribute, propagate, provide, participate in, enable or support analytical, automatic or unattended download systems or similar systems (including, without limitation, robots, spiders, offline readers, etc.); or
• use, employ, download or otherwise copy any content on our website or transmit such content to another person for any commercial undertaking or purpose.

1.4 Use Limitation

Use of our Services: You may use our Services only in compliance with all applicable laws, including copyright and trademark laws.

Distributing or sharing copyrighted content may result in legal consequences and IGSaver accepts no responsibility. As a user, you should be responsible for ensuring your actions comply with all applicable laws and regulations.

IGSaver does not warrant that our Services will meet your requirements, be uninterrupted, timely, secure or error-free, nor does IGSaver warrant that the results that may be obtained from the use of our Services will be accurate or reliable. IGSaver does not warrant that the quality of any products, information, material, or other content obtained through the use of our Services will meet your expectations or that any errors in our Services will be corrected.

1.2 IGSaver does not warrant that our Services or the content contained therein will be available or appropriate in all countries, and access from certain countries may not be legal. If You access our Services from Your country, You are responsible for compliance with local laws.

1.3 You understand and agree that IGSaver shall not be liable for any loss of profits, income, turnover, goodwill, contracts, opportunities, anticipated savings, data, goodwill, or any other intangible losses resulting from the inability to use our Services, or from the provision or failure to provide services by us.

1.4 For the avoidance of doubt, IGSaver shall not be liable for any claims or any other liability arising out of or related to your use or inability to use our Services, whether based on warranty, contract, tort (including negligence), or any other theory, regardless of whether IGSaver has been informed of the possibility of such damage.

1.5 Some jurisdictions do not allow the exclusion or limitation of unforeseeable or consequential damages, so the above limitations or exclusions may not apply to you.

Suspension or Termination

1.1 IGSaver may, in its sole discretion, suspend or terminate your use of our Services under the following scenarios:

• If we believe that You have or may have breached any term of this Agreement;
• If Your use of our Services poses a risk to us or any of our other users or licensors;
• If You use our Services in a manner that infringes copyright;
• If You use our Services in a manner that breaches applicable laws;
• If IGSaver is investigating suspected misconduct; or
• If IGSaver faces potential legal liability.

1.2 In the event of any such suspension or termination, You will continue to be bound by the obligations in this Agreement, including your obligation to pay any payments (if any).

Amendments to The Agreement

1.1 IGSaver reserves the right to amend this Agreement at any time, which shall take effect and apply immediately. If You disagree, You have the right to stop the Services agreed herein. Once the changes of our agreements have been published, Your continued use of IGSaver's Services is deemed to have fully read, understood, and accepted the changed agreements, and shall abide by such agreements.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IGSaver AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF INCOME OR BUSINESS, LOSS OF DATA, COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, OR ANY OTHER TYPE OF LOSS OR DAMAGE, WHETHER BASED IN TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, WHETHER OR NOT FORESEEABLE AND WHETHER OR NOT IGSaver HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL IGSaver'S AGGREGATE LIABILITY TO YOU EXCEED ANY FEES THAT YOU HAVE PAID (IF ANY).

THE LIMITATIONS AND DISCLAIMER IN THIS SECTION DO NOT PURPORT TO LIMIT LIABILITY OR ALTER YOUR RIGHTS AS A CONSUMER THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

Indemnity

YOU UNDERTAKE TO INDEMNIFY US AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS ON DEMAND AGAINST ALL CLAIMS, ACTIONS, CHARGES, COSTS, EXPENSES, DEMANDS, DAMAGES, LIABILITIES, PROCEEDINGS OR JUDGMENTS ARISING OUT OF OR IN CONNECTION WITH YOUR BREACH OR VIOLATION OF THIS AGREEMENT, OR YOUR INFRINGEMENT OF ANY THIRD PARTY'S RIGHTS.
